  1. Terms of Sale
    1. The display of Goods on this website does not constitute an offer to sell them as described, or to sell any goods at all.  By clicking to place an order, you are making an offer to buy which incorporates these terms.  If we elect to accept your offer, you will receive an order confirmation.  We reserve the right to decline any order, without giving a reason.

    2. In order to be eligible to place an order through this website, You must be over the age of 18 and provide the required information including real name, payment details, delivery address, email address and telephone number.

  2. Orders
    1. Orders are only binding when the order confirmation is received.  You should check the order confirmation and notify the Supplier of any mistake by email or telephone immediately otherwise the details stated in the order confirmation will apply to the Agreement.

  3. Availability
    1. If you order Goods and we accept the order, we reserve the right to notify you at any time before delivery of the unavailability of the particular Goods ordered.  You can then cancel the Agreement and we will refund you all money paid in full.  Alternatively, you can accept any equivalent product we offer to you.

  4. VAT
    1. Unless they are expressly quoted as not including VAT, all prices are inclusive of value added tax and other government taxes or duties.
  5. Payment
    1. We accept Visa, Mastercard and Laser. Your card will be debited 1-2 days after you confirm your order with us.  We also accept payment via PayPal.

  6. Delivery
    1. Delivery will usually take no more than seven - 10 days from the order confirmation, but in the unlikely event that the Goods you have ordered (or any part of them) are out of stock, it may take longer than that.  You will be notified as soon as we process your order if the Goods ordered (or any part of them) are out of stock. 
    2. Our delivery policy applies to Ireland and the United Kingdom.  Deliveries outside of these areas will be handled on a case-by-case basis; delivery prices and lead times will vary depending on location.  Please email info@corkglass.ie if you require delivery outside Ireland or the United Kingdom
    3. We will use reasonable efforts to meet any delivery date, but it should be understood that they are estimates and we are not liable (in contract, negligence or otherwise) for any loss or damage resulting from them not being met, howsoever caused.  Goods are shipped to the delivery address you gave, as stated in the order confirmation.
    4. You have the option of an assembly service at the time of your purchase.

  7. Title
    1. Title to Goods ordered passes to you when the Goods are shipped, or if later when you make full payment.
  8. Installments
    1. Where you have ordered more than one item, we may make delivery in one or more instalments.

  9. Your Right to Cancel
    1. If you wish to cancel your order for any reason and return the Goods delivered, you are entitled to do so within 7 days of receipt of the Goods by you.  To cancel you should telephone us and then confirm your cancellation in writing.  You should also include a return note and proof of purchase.  The Goods must be in their original condition with packaging complete and seals unbroken.  You are responsible for the direct cost of returning the Goods to us.  No refund will be made until the Goods are returned to us and, in any event, no refund will be forthcoming if the Goods are not received by us within 30 days of you notifying us of your intention to return them.
    2. If the Goods are found to be either damaged or defective in any way at the time of delivery you must notify us by email as soon as possible (and in any event within 48 hours of delivery).  Your email should include your name, address, order number, date of receipt of Goods, details of the item concerned and a brief description of the damage or defect.
    3. If the Goods are damaged or defective, we shall, following the return of the relevant item to us, at our option, either:
      1. repair the item to manufacturing standards; or
      2. send a replacement item; or
      3. refund the monies paid by You for the Goods.

  10. Proces Quoted
    1. Unless otherwise stated, prices quoted are only valid during your browser session.

  11. Queries & Complaints
    1. Notification of queries and / or complaints can be made to us by email at info@corkglass.ie.

  12. Warranties
    We warrant that
    1. at the time of sale, we will have title to sell the Goods to you; and
    2. the Goods sold to you will conform with the specification for them published by us or their manufacturer.

  13. Remedy
    Subject to Clause 16, if we are in breach of the warranties given by us under Clause 12, our liability shall be limited to:-
    1. replacement of the Goods concerned; or
    2. at our option, reimbursement of the price

  14. No Other Liability
    1. Subject to Clause 16, we will have no further liability to you other than as described in Clause 13, whether under these terms or on any other basis, including liability in tort as a result of the sale of the Goods.
    2. 14.2. Without prejudice to Clause 14.1, we point out that the Goods are made from natural wood and many are handmade. Colours and measurements may vary as a result and natural wood can have natural minor defects and imperfections and can move slightly even after manufacture. Any colours or measurements shown on the website are for illustrative purposes only and cannot be relied upon and we shall have no liability whatsoever to you in this regard.

  15. Consequential Loss Etc.
    1. 15.1. Subject to Clause 16, we will not, under any circumstances, be liable to the Customer by reason of any representation or warranty, condition or other term or any duty of common law, or under the express terms of these terms, for any consequential, special, incidental or punitive loss or damage (whether for loss of current or future profits, loss of enterprise value or otherwise) and whether occasioned by our negligence or that of our employees or agents or otherwise, even if advised of the possibility of such damages.

  16. Non Excludable Liaility
    1. Nothing in these terms shall exclude or limit our liability for death or personal injury resulting from our negligence, or that of any of our employees or agents, nor shall they operate to exclude or limit any statutory rights which cannot be legally excluded or limited, including the statutory rights of a consumer.

  17. Force Majeure
    1. We are not liable for delays in performance (including delivery or service) caused by circumstances beyond our reasonable control and will be entitled to a time extension for performance. Examples include strikes, problems with suppliers or transport, industrial relations problems, exchange fluctuations, governmental or regulatory reaction and natural disasters. If the conditions last for more than two months, the Agreement may be terminated by either party without compensation.

  18. Entire Agreement
    1. These terms expressly incorporate our Privacy Statement and Website Terms and Conditions. Together, they contain the entire understanding and agreement between the Supplier and the Customer relating to the sale of products to the Customer through this website.

  19. Govenring Law
    1. These conditions of sale shall be governed by Irish law and the exclusive jurisdiction of the courts of Ireland.

  20. Interpretation
    In these terms of business:-
    • the “Agreement” means the agreement which is formed when we accept an order from you, as provided in Clause 2.
    • “Supplier”, “we” or “us” means Rapid Glass LTD, a company registered in Ireland with number 363478 and registered office at UNIT 3, KINSALE ROAD BUSINESS PARK, KINSALE ROAD, CORK and which trades under the business name Cork Glass.
    • “these terms” means the terms of business set out in this document.
    • “Customer” or “you” means the person who purchases Goods via the corkglass.ie website.
    • “Goods” means the goods described in the order confirmation.

    1. You may access most areas of this Website without registering your details with us.  Certain areas of this Website may only be open to you if you register.

    1. While we endeavour to ensure that this Website is normally available 24 hours a day, we shall not be liable if for any reason this Website is unavailable at any time or for any period.

    3. We may at any time and without liability modify, suspend or discontinue the Website with or without notice, for any technical, operational or commercial reasons.

Without prejudice to the foregoing, we may seek provisional or protective relief in the courts of another State prior to, during or after any substantive proceedings have been instituted in Ireland and we may bring enforcement proceedings in another state on foot of an Irish judgement.
    4. If any provision of these Terms is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions, which shall remain in full force and effect.
